Terms of Service & Refund and Cancellation Policy

These Terms of Service and Refund and Cancellation Policy ("Terms") govern the astrology consultation offered through astronareshkumarsharma.com (the "Website"). Please read them carefully, together with our Disclaimer and Privacy Policy, which form part of these Terms.

1. Who we are (seller information)

1. The service is provided by Naresh Kumar Sharma, an individual sole proprietor practising Vedic astrology in India ("we", "us", "the Astrologer"). The Website and related accounts are managed on his behalf by family members.

2. Acceptance of these Terms

1. By making a payment for, or booking, a consultation, you confirm that you have read, understood and agree to these Terms. Payment or booking is your acceptance of our offer within the meaning of the Indian Contract Act, 1872.
2. These Terms are an electronic record under the Information Technology Act, 2000. Acceptance by clicking, paying or booking online is valid and binding and does not require a physical or digital signature.
3. If you do not agree to these Terms, please do not pay for or book a consultation.

3. Eligibility and capacity

1. You must be at least 18 years old and competent to contract under Indian law to make a booking.
2. A parent or legal guardian may book a consultation concerning a minor and accepts these Terms on the minor's behalf.
3. If you book for another adult, you confirm you have that person's consent to share their birth details with us.

4. The service

1. One personal 30-minute Vedic astrology (kundli / birth chart) consultation by phone or video call, in Hindi or English, by Naresh Kumar Sharma (15+ years of experience).
2. You may ask about areas such as career, finance, health, marriage and family. Guidance may include simple remedies, which are always optional.
3. We do not sell gemstones (ratna), yantras or any other products, and we do not require you to buy anything.
4. The service is delivered only as a live call. Nothing is shipped physically.

5. Fees, taxes and payment

1. Fee: ₹1,000 per 30-minute consultation for clients in India; USD 30 per 30-minute consultation for clients outside India (international payments opening soon).
2. The price shown on the Website before payment is the total amount payable for the consultation, inclusive of any applicable taxes. If GST becomes applicable, it will be shown before payment.
3. A follow-up consultation is a new booking at the same fee.
4. The full fee is paid in advance through Razorpay. Your card, UPI and bank details are processed by Razorpay; we do not see or store them. Razorpay's own terms apply to the payment transaction.

6. Booking and scheduling

1. After payment, you book a slot through our Cal.com booking page and enter your Razorpay payment ID, WhatsApp number, date of birth, birth time, birth place, question and preferred language.
2. Slots are available from 24 hours after booking, every day from 11 AM to 8 PM IST.
3. A booking is confirmed only when a valid Razorpay payment ID matching a successful payment is entered. We may cancel a booking that has no matching payment.
4. Please be available on the WhatsApp number or video link you provide at the booked time.

7. Birth details and accuracy

1. The reading depends entirely on the birth details you give. You are responsible for their accuracy.
2. All calculations are done only on the basis of the details you provide: date of birth, time of birth (clearly stated with AM/PM) and place of birth. If any wrong or incomplete information is entered, you alone are responsible for the result, and no refund will be given.
3. If your birth time is unknown, approximate or incorrect, the reading will be limited. This is not a ground for a refund.

8. Refund and Cancellation Policy

1. No refunds: Fees are not refunded for change of mind, cancellation by you, dissatisfaction with a reading, or the outcome of any event, because astrology is interpretive guidance and no outcome can be guaranteed.
2. One free reschedule: Request it by WhatsApp or email (or through the Cal.com reschedule link) at least 2 hours before the slot. Further changes need a new booking.
3. No-show: If you do not join the call at the booked time without notice, the consultation is treated as delivered and no refund or reschedule is due.
4. If we cannot deliver: If the Astrologer is unable to hold the consultation and cannot offer a mutually suitable rescheduled slot within a reasonable time, you will receive a full refund to the original payment method. This does not limit any right you have under the Consumer Protection Act, 2019.
5. Duplicate or failed payments: If you were charged twice or charged without a booking being possible, contact us; verified duplicate charges are refunded in full, normally within 7–10 working days via Razorpay.

9. Nature of astrology and no guarantee

1. Astrology is a belief-based, interpretive practice offered for guidance, perspective and entertainment. It is not a science and no specific result or outcome is promised or guaranteed.
2. You remain solely responsible for your own decisions and actions.
3. The consultation is not medical, legal, financial, psychological or crisis advice and is not a substitute for a qualified professional.
4. In line with the Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954, we do not claim to diagnose, cure, treat, mitigate or prevent any disease or condition. Health-related readings are guidance only; continue your doctor's advice and never stop or change medicine based on a reading.
5. Remedies suggested are simple and optional. Nothing must be purchased.

10. Recording and confidentiality

1. The Astrologer does not record consultations.
2. You must not record, publish, or share a recording of the call without the Astrologer's prior written consent.

11. Conduct

1. Calls must be respectful. If you are abusive, threatening, harassing or obscene, the Astrologer may end the call, and it will be treated as delivered without refund.
2. You must not use the service for any unlawful purpose or to obtain information about another person without their consent.

12. Network failures and force majeure

1. If a call is interrupted by network, telecom, internet or power failure on either side, we will try to reconnect; if that fails, the remaining time will be rescheduled. This is a reschedule, not a refund.
2. We are not liable for delay or failure caused by events beyond reasonable control, including natural disasters, illness, government action, epidemics or outages of third-party services (Razorpay, Cal.com, Google, telecom providers). Affected consultations will be rescheduled.

13. Payment disputes and chargebacks

1. Please contact the Grievance Officer before raising a dispute with your bank or Razorpay.
2. If a chargeback or payment dispute is raised for a consultation that was delivered (or treated as delivered under clause 8.3 or 11.1), we may contest it using booking records, call logs and correspondence.

14. Limitation of liability

1. To the maximum extent permitted by law, our total liability for any claim relating to a consultation is limited to the fee you paid for that consultation.
2. To the extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, including loss of profit, opportunity or relationships, arising from reliance on a reading.
3. Nothing in these Terms excludes liability that cannot be excluded under Indian law.

15. Indemnity

You agree to indemnify us against losses, claims and reasonable costs arising from your misuse of the service, your breach of these Terms, false or unauthorised information you provide (including another person's details without consent), or your unauthorised recording or publication of a consultation.

16. Intellectual property

All Website text, design, logos and images belong to the Astrologer or are used under licence. You may not copy, reproduce or commercially use them without prior written permission. Personal, non-commercial viewing is permitted.

17. Privacy

Your personal data is handled under our Privacy Policy in line with the Digital Personal Data Protection Act, 2023.

18. Third-party services

Payments (Razorpay), scheduling (Cal.com), email (Google/Gmail) and hosting (Cloudflare) are provided by third parties under their own terms. We are not responsible for their outages or acts, but will help you resolve any issue affecting your booking.

19. Changes to these Terms

We may update these Terms. The updated version is posted on this page with a new "Last updated" date. The version in force on the date of your booking applies to that booking.

20. Grievance redressal

2. We will acknowledge your complaint within 48 hours and aim to resolve it within one month of receipt, as required by the Consumer Protection (E-Commerce) Rules, 2020.

21. Governing law, disputes and consumer rights

1. These Terms are governed by the laws of India.
2. Both parties will first try to resolve any dispute in good faith through the Grievance Officer.
3. Subject to clause 21.4, courts at [City, State], India have jurisdiction.
4. Nothing in these Terms limits your rights under the Consumer Protection Act, 2019, including your right to approach the appropriate Consumer Commission or the National Consumer Helpline (1915).

22. General

1. Severability: If any provision is held invalid or unenforceable, the rest remains in effect, and the provision applies to the maximum extent permitted.
2. Entire agreement: These Terms, the Disclaimer and the Privacy Policy are the entire agreement between you and us about the consultation.
3. No waiver: Failure or delay in enforcing a right is not a waiver of it.
